A new rule requiring drug companies to announce the list price of the drugs that they advertise on TV has been blocked by a federal judge. The rule would have put pressure on the drug companies to reduce prices. After all, who would rush out to get a drug that cost $3000 per month or something higher? The judge said that the government didn't have the power to require this. Supposedly, it's ok for the regulations to make the drug companies list the major side effects of a drug, but not the price.
When I heard the news, I immediately figured that the judge involved had been appointed by president Obama. These days, no matter what act the Trump administration takes, there's always a political Obama appointee on the bench to block it. Sure enough, the judge in this case is one appointed in 2014 by Obama.
It's sad that it is so predictable these judges who block regulations. There's no way that the decisions are just legal process taking place. We are seeing a political attack ring at work on the bench. Judges are supposed to follow the law, not their political wishes.
Don't get me wrong. I don't know if this case was decided correctly. It sounds wrong to me, but I haven't researched it to come to a conclusion. I just think that it is a sad day when the administration of justice by the federal court system is so politicized that one can tell who appointed the judge just by hearing the decision.
