Here's the latest from Slate write Dahlia Litwick: President Trump chose Brett Kavanaugh because Trump was scared that Robert Mueller might try to indict him and Kavanaugh would block such an indictment. It's another bit of pure BS from the left.
Let's start with the obvious: The US Department of Justice decided decades ago that a sitting president cannot be indicted by the federal government. That is the policy of the DOJ and that policy restricts all DOJ employees. That means that the policy restricts Robert Mueller who is a special prosecutor but who works in the DOJ and reports to the Deputy Attorney General, Rod Rosenstein. Rosenstein, by the way, has to approve of any indictment that Mueller wants to bring before the indictment can proceed. Thus, Mueller is already restricted from a criminal indictment of Trump even if he were inclined to bring such an indictment. Of course, there is not even a hint of any possible indictment of Trump. There's no proof he colluded in any way with Russia. He didn't obstruct justice. There's just no basis for an indictment. So, this means that there's no reason for President Trump to fear and indictment and no reason for him to choose Kavanaugh to guarantee that outcome.
Now let's take it one step further: most legal scholars (aside from the most strident lefties) agree that a sitting president cannot be indicted. That means that the likely outcome of a Supreme Court case decided by the present court would have been an easy Trump victory. The argument advanced in Slate is the equivalent of calling for a person to get vaccinated against a disease that doesn't exist.
