New Member for the Idiocy Hall of Fame

It's time to induct a new member in the Idiocy Hall of Fame.  Today's honoree (?) is Gregory Diskant, a supposed "legal scholar" and member of the board of Common Cause.  Diskant gets his place due to his argument that the Senate has waived its right to approve president Obama's nomination of Merrick Garland to the Supreme Court, so Garland should just take his seat on the Court.

Think about that for a moment.  For the entire history of the USA, no person has joined the Court without approval from the Senate.  There's a good reason for that history; the Constitution requires the "advice and consent" of the Senate for each member of the Court.  The Constitution doesn't place a time limit on that consent.  No matter how liberal the "legal scholar" is, he should understand this.  The idea that Garland can just take his seat now is preposterous.

I wonder what Diskant would think of this argument:  The FBI has taken so long to investigate Hillary Clinton's email system that Hillary should just go to jail.  Any indictment and trial has been waived by inaction.  I doubt he'll buy it, but with a moron like this, one never knows.
