It has now been disclosed that the memoranda written by former FBI director Jim Comey about his conversations with President Trump contained classified material. Think what that means. Comey testified under oath to a congressional committee that he gave at least some of the memos to a friend so that they could be leaked to the news media. If those memoranda contained classified information, then leaking them to the media is a felony. Comey let Hillary Clinton off the hook for mishandling classified information because he claimed she didn't have the requisite intent. While that is a wrongful interpretation of the law, Comey doesn't even have that defense. After all, he admits that he intentionally set in motion the leaking to the press of these memoranda. That's a clear statement that his actions were intentional.
We still don't know exactly which memoranda have classified info or which ones Comey gave to his friend. That seems to be the only open issue here. The Mueller probe will have to investigate which memoranda fall within each category. If it turns out that Comey leaked classified info, we will have the bizarre outcome that the special prosecutor that Comey tried so hard to get appointed will be the one who ends up indicting Comey for a felony.
Things just get "curiouser and curiouser".
