The Obama administration announced yesterday that the state law in North Carolina which requires that people use bathrooms that conform to their biology violates federal law. Since according to the Obamacrats, the law violates federal education law requiring no discrimination based upon sex, etc., the law puts in jeopardy hundreds of millions of dollars that North Carolina gets from the feds for schools.
Let's take a moment to look at what the Obamacrats are saying. Legally, the state cannot discriminate in education based upon sex. So, is it sex to tell people to use a bathroom that conforms to their bodies? The Obamacrats say that it is. After all, some people identify as a gender different from their own bodies and (and this is the key point) the state has to recognize that and honor their choice. The simple question is why? Nothing in federal law says that. It does not mention any requirement that schools must provide bathrooms for students in accordance with their gender identities. Indeed, it does not have any requirements regarding gender identities. So why is this discrimination?
Let's consider an slightly different example. There is a well known psychological status related to the city of Jerusalem. Every year people come to Jerusalem and once there they come to the conclusion that they are either God or a saint or a prophet. In other words, they identify as holy. If one of those people were to come to the USA and attend school in North Carolina would the state have to grant that person special rights in accordance with their self-identity as a holy person? Would failure to do this be discrimination based upon religion? There's really no meaningful difference between what the feds are saying and this.
Or perhaps we should present a problem that will really upset the Obamacrats in Washington. In North Carolina there is a significant Moslem community. We know this from the terrorist attack there (excuse me, the random and senseless violence that just happened to have been perpetrated by a Moslem which had nothing to do with Islam despite what he said.) There are female (both by body and identity) Moslem teens who wear head scarves to school for modesty as prescribed by their religion. For these women it is intolerable and violates their religious beliefs to use a bathroom simultaneously with a man who happens to identify as a woman. Putting transgenders into the women's bathroom or locker room at school is religious discrimination against these Moslem students. Why aren't the Obama bureaucrats more sensitive to the religious needs of these Moslem women? The answer is simple: the Obamacrats are Islamophobic. It's a national disgrace.
To be fair, the real issue in NC is not with Moslem women but with all people who have a desire for modesty and privacy. I just picked out the Moslem women to make a point in a way that the Obamacrats should understand.
The simple truth is that Obama and the Obamacrats are wrong when they try to foist their bathroom rules on the average American. The sooner they realize it, the better.
