A group led by former Obama attorney general Eric Holder filed suit today in Wisconsin against governor Scott Walker because of Walker's decision not to hold a special election to fill two seats in the legislature. The suit alleges that Walker is subverting democracy and violating the constitution by failing to take steps to fill these seats. Both are vacant because the Republicans who held them resigned to take positions in Walker's administration.
The media is covering this as a valiant attempt by Holder's group to get representation for the people in the two districts. That's silly. The truth is that the Wisconsin legislature will adjourn for the year for transaction of new business by the end of April. There is no way to set and hold special elections so as to fill the two seats by then. Walker saw no reason to incur the expense of holding elections to fill seats when there will be no legislative sessions for the winner to attend.
