Some Bad News For Hillary

This morning, I would have put the odds of Hillary Clinton being indicted for improper storage of classified information on her private unsecured email system at 15-20%.  Today has brought news that raises that likelihood to at least 25%.

The news is that those Top Secret emails on Clinton's system have been reviewed within the government, and it has been confirmed that they were not only classified, but also Top Secret.  Here's how the news report from Fox News put it:

An intelligence community review has re-affirmed that two classified emails were indeed “top secret” when they hit Hillary Clinton’s unsecured personal server despite a challenge to that designation by the State Department, according to two sources familiar with the review.
The sources described the dispute over whether the two emails were classified at the highest level as a “settled matter.”

There have been approximately 1000 emails on the Clinton server (out of about 20,000 released so far) that contain classified information.  There is no way that Hillary Clinton was unaware of this.  She was, after all, the secretary of state and had been briefed repeatedly about keeping secret information secure.  She well knew the sort of information that had to be classified.  The Top Secret emails in question, however, were of a much higher level of secret.  One apparently was a report on certain North Korean nuclear activity.  Even a moron would understand that this was a national secret.  When these emails came to light earlier this year, the State Department tried to cover for Hillary by contesting the classification of the emails as Top Secret.  That issue has now been decided against Mrs. Clinton.

An indictment of Hillary Clinton would still require Loretta Lynch to sign off on such a move.  Because of the potential political ramifications to her party, Lynch is still unlikely to make that move.  Nevertheless, we have gotten to the point where a decision by Lynch not to indict Hillary will clearly be a strictly political move.  The law and justice requires the indictment, but for the Obama administration, law and justice are almost always overruled by political needs.
