Todya's nomination of Elena Kagan to the Supreme Court is another instance where spin wins. Kagan has very little record from which one could determine her competance to be a justice on SCOTUS. She was never a judge so there are no decisions she has written. Even though she got to be dean of Harvard Law School, she has essentially no legal articles taht she has written. There seem to be three and for all they reveal about her views, they could be recipes for pot roast. She is, in other words, a stealth justice like David Souter was when he received the nomination from the first President Bush. We all know how that nomination turned out: Souter was totally different from what was expected at the time.
I have to assume that Obama has fully vetted Kagan and knows her views. Of course, this is the same administration that vetted the Treasury Secretary but did not find out that he had cheated on his taxes. They missed similar glaring problems with a whole host of other appointments. Who knows, maybe Kagan will turn out to be one of the best (or worst) justices ever if she is confirmed. I would prefer someone with more of a record, but it is Obama's choice who he selects. Certainly, Kagan has the intellect to operate at the level of the Court (or at least she appears to be able to do so.)
