The Democrats in the Senate today chose to use to so called nuclear option to get their way on judicial nominees. Basically, the Democrats changed the Senate rules so that judicial and cabinet nominees could not be subject to a filibuster. The rule they changed has been in place since it was written by Thomas Jefferson over two hundred years ago. According to the Democrats, the rule change was needed because the Republicans were blocking judicial appointees by means of filibusters.
This was a really stupid move by the Democrats. I understand that they are trying to change the subject from Obamacare, but this is not a good switch for them. Indeed, it is just another place where a Democrat lie will be brought to light. There has not been any move by Republicans to block judicial appointees. Since president Obama took office, over 200 nominees for judicial positions were approved by the Senate and two were rejected. Since the beginning of the nation over 200 years ago, no Supreme Court nominee was ever blocked by a filibuster and no District Judge was blocked using that method either. During that 200 years, ten people nominated to the court of appeals were blocked by filibusters; five were Republicans and five were Democrats. There was not any problem that required the rules change.
My suggestion is that folks not get too caught up in this filibuster mess. Let's not take our eyes off the ball which is disaster of Obamacare. After 2014, there may well be a Republican majority in the Senate and the House. At that point, the Republicans ought to use the same methods on the Democrats that those Democrats chose today. The Republicans should not allow Democrats to filibuster anything moving forward if they gain control. They can call it the Harry Reid anti-filibuster rule.
