Some Sanity Regarding Waters of the United States

In an order today, the 6th Circuit Court of Appeals stayed the enforcement of the new EPA regulations governing what the EPA calls the "waters of the United States" but which might better be called "every river, lake, stream, pond, puddle or wet spot" in the USA.  This is not a final decision overturning the rule, but a review of the court's reasoning makes pretty clear that these judges are unlikely to let the rule stand.  To be clear, the regulation in question would have the federal government getting involved with regulating all sorts of waters, something that has been the province of the states since the birth of the USA.   

This is a good development.  There is no need for national regulation of local waters.  It is also another way to stop the attempted federal regulatory takeover of everything.
