Yes We Kohn

I use Sally Kohn as a symbol of everything that is wrong with out political system.  Supposedly, Kohn is a "commentator" for CNN.  I realize that means that no one sees her commentary, but it, nevertheless, ought not be ignored.  Kohn's latest commentary is to lambaste House speaker John Boehner for the lawsuit that the House is bringing against president Obama due to his failure to obey the Constitution.  Kohn's basic point is that Obama is doing nothing other than what all presidents do.  Her biggest point of supposed evidence is that Obama has issued only 182 Executive Orders, a number lower than was issued by many previous presidents.

Let's stop here for a moment.  I have no doubt that Kohn understands full well that her argument is not only flawed by idiotic.  The lawsuit by the House is not about the illegal actions taken by Obama through Executive Orders.  The lawsuit is about Obama refusing to enforce the law and actually changing that law.  The best example of this is Obamacare.  That law was passed in 2010.  Since that time, Obama has made about 30 separate changes to the provisions of Obamacare.  None of those changes were made by Executive Order; Obama just issued a press release or said something on the White House website that altered the law.  For example, Obamacare specifically required that the Employer Mandate go into effect on January 1, 2014.  There is no provision in the law that authorizes the president to delay that date, but over a year ago, Obama announced a one year delay so that the effective date came after the elections in November.  So the law requires one thing, but Obama is doing something else.  Then there is the immigration laws which have specific rules for how the federal government is to treat those here illegally.  At the beginning of his first term, Obama asked Congress to pass the Dream Act, a statute that would have authorized the feds to let young people brought here as children stay if they either served in the US military or graduated from college here.  Even though the Congress was under the total control of the Democrats at the time, the Dream Act was not passed.  That did not stop Obama; he just changed to way the federal government enforces the immigration laws to act as if the Dream Act had passed.  There was no Executive Order issued here, either.  Instead, there was a rejection of the change by Congress followed by the president ignoring his obligation under the Constitution to follow and enforce the actual laws of the USA.

The counting of Executive Orders and claiming this to be a justification for Obama is not a position unique to Sally Kohn.  Some of the other liberal repeaters of talking points also use it.  Nevertheless, these are talking points to justify undermining the US Constitution.  These are talking points to "explain" why Obama seeks to destroy the foundation of American liberty.  In other words, these are not just the usual lies; they are pernicious words that ought not be uttered.  And Kohn should be told this, even on CNN.
